What to Do if I have been Exposed to Mold?
When people encounter mold they often don’t realize the potential dangers involved in being exposed to mold. Even though some mold is more dangerous than other, effects of the most dangerous kind of mold can be devastating, even deadly. Working at a law firm you hear all sorts of phone calls from people asking whether they can use for being exposed to mold. Normally the caller states that the land owner (usually an apartment manger) has knowingly allowed mold to remain on premises and that they now fear for their health and seek advice on whether they are able to sue or not. There are several things you need to know before considering filing a lawsuit for mold-related injuries.
- Unless a doctor has diagnosed your condition and has stated that it is due to mold, you have no case. Without a doctor’s diagnosis it is impossible to file any sort of personal injury claim. The first thing to do when you’re suffering from possible mold exposure is to go see a doctor. The doctor will not only help you by prescribing the right treatment, he or she will also act be able to give proof to your claim by pointing out the direct cause of the injury.
- If the effects of mold exposure clear up, chances are you can’t file any claim. Unlike other injuries, mold effects on the body are not permanent, in fact they disappear as soon as you leave the area in question. Most issues clear up soon after leaving the molded area, thus there is nothing you can file a lawsuit for.
- Unless you have actual bills relating to the mold exposure, assuming the diagnosis was actual mold and the treatment was related strictly to the diagnosis, there is nothing you can claim. Filing a lawsuit simply because you’ve been in an area where mold was allowed to grow is close to impossible without the supporting points below. There needs to be actual neglect involved, harm and monetary expenses involved for a lawyer to try to recover something.
In cases where mold leads to death, serious claims can be made for significant compensation for the grief of your passed family members. If you are unsure where to find an attorney, consider the Injury Attorneys Guide attorney directory. This is a great directory that allows you to find an attorney, and if you are an actual law firm then you are able to place your attorney listing there as well. Now that you know what’s involved in a mold exposure claim, you may act appropriately and save everyone a lot of time in the process.
Unlicensed Driver Survies, Kills 3 Passengers
An unlicensed driver slammed into a tree Tuesday, killing 3 out of the 5 passengers, whom were all ejected out of the vehicle. The crash took place in the 1400th block of West Florence Ave in South Los Angeles. Three women died from injuries while in the hospital and the driver is still hospitalized in critical condition.
Police say they found alcohol in the vehicle, but have yet to arrest the driver. An investigation is underway.
Law enforcement sources with knowledge of the case say the female driver was cited on Jan. 3 by the California Highway Patrol for driving without a license. Her vehicle was not impounded.
It is unclear what type of conditions the other injured passengers are in at this point but the accident has sparked an ongoing debate involving citations and unlicensed driver vehicle impounds. Full article is available on the LA Times website.
These types of accidents are not uncommon in Southern California, although it is unclear whether any wrongful death attorneys will be involved.
Woman Escapes Major Injuries Aftern Plunging Into Ravine
In Clairemont today, a vehicle went off-road and into a steep ditch next to the onramp resulting in a crash and injury for a woman who was taken to the hospital. The crash occured at the Genesee Ave and Route 52 said the investigative authorities.
After skidding for more than one hundred feet, the vehicle came to a stop and paramedics arrived on the scene shortly after, rescuing the woman and placing her into the ambulance to be carried of to the hospital.
Hopefully the woman is alright and suffered no major injuries. The crash is still under investigation and the cause is yet unknown. Car accidents are not uncommon, however this vehicle went off-road which is a totally different type of incident (unless the investigation reveals another vehicle involvement).
Various Types of Accidents Involving Semi Trucks
The highways in the U.S. are not so safe after all, each year resulting in hundreds of new accidents involving semi trucks. Eighteen-wheelers account for the majority of “jack-knife” collisions as well as tire punctures and catastrophic roll-overs. In most cases, when an eighteen-wheeler comes in contact with a smaller car, the passengers of the car do not survive. Whether by decapitation, traumatic brain injury or severed limbs, car passengers normally do not make it out alive from accidents involving large commercial freight trucks.
Some of the most dangerous and common truck accident types are called “jack-knife” accidents. They get this name from the nature of the folding of the trailer and the cabin similar to the folding pocket knife. When a driver sees an obstacle on the road and quickly swerves to avoid it, he/she often lose control of the vehicle due to the force of the trailer folding in towards the cabin. This type of accident is responsible for many overturned and discombobulated vehicles that allow for little or no room for the vehicles behind it to maneuver around.
Rollovers are especially dangerous because they can smash a vehicle traveling alongside the truck. Frequent causes for rollovers are curbs that a driver hits at an angle, usually on a steep hill – causing the vehicle to overturn due to the sheer massive weight of the trailer. The weight of the vehicle itself poses great dangers to nearby cars that stand to be crushed completely upon contact.
Tire blow outs are fairly frequent, although do not always result in loss of control of vehicle. Since trucks have so many tires to begin with, it is not all too common for an 18-wheeler to lose control and roll over, however it does occur. Tire blow outs also result in jack-knifing which is described above.
Serious and deadly accidents occur especially when a driver can’t stop in time and smashes into the rear of a semi-truck, becoming lodged in the undercarriage of the truck. You can only imagine what kind of horrific scene can result from such accidents.
Truck injuries can be very serious and often deadly. Knowing the right truck accident attorney can make your life a bit easier after suffering an injury in a truck accident or losing a loved one in a serious truck accident.
San Diego Child Bit, Dog Impounded, Owners Arrested
Unfortunate news came out of the San Diego police department today when a dog bit a child, and the office who tried to stop the incident from happening.
A dog bit a small child and a policeman Sunday after San Diego police discovered the owners and their pets in an empty house in the Southeastern San Diego area of Shelltown.
Both injured were moved to the hospital for nonlife-threatening bites, a San Diego policeman said.
Police came on scene at the residence around 12:00pm Sunday to discover the owner of two gray pit bulls in the house. The pets got through the fence and one bit a small child passer-by in the hand. When a law enforcement officer tried to get in the way, the officer got bitten as well, according to Lt. Dan DeSousa with the San Diego County Department of Animal Services.
The course of events happened outside a house near the corner of Epsilon Street and South 41st Street, DeSousa said.
It was hazy if the same dog bit both people, De Sousa said, but all 3 animals were taken in for quarantine and the owners were brought to the police station.
This is terrible news that nobody wants to hear, especially when a child of such young age is involved. In cases like this it is important for parents to consult dog bite attorneys for full compensation by negligent owners.
